Gus Labs operates this store and website to provide you with a curated shopping experience (the "Services"). Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products to you.
This Privacy Policy describes how your personal information is collected, used, and disclosed when you visit or make a purchase from our store. By using our Services, you acknowledge that you have read this Privacy Policy and understand the division of responsibilities between Gus Labs and our platform host, Shopify.
1. Personal Information We Collect
When we use the term "personal information," we are referring to information that identifies or can reasonably be linked to you. We collect or process the following categories of personal information:
- Contact & Shipping Details: Your name, billing address, shipping address, phone number, and email address.
- Account Information: Your username, password, and preferences.
- Transaction & Usage Information: The items you view, put in your cart, purchase, or return, as well as your IP address and device information.
2. Financial Information & Payment Security (Important Disclaimer)
Gus Labs does NOT collect, process, or store your credit card numbers, bank account details, or sensitive financial data. All payment processing is handled securely by third-party PCI-DSS compliant payment gateways (such as Shopify Payments, Afterpay, or PayPal). When you make a purchase, your payment data is encrypted and securely transmitted directly to these processors. Because Gus Labs never possesses or controls your financial data, we accept no liability for any data breaches, unauthorized access, or fraud that occurs at the payment gateway or processor level.
3. How We Use Your Personal Information
We strictly use the information we can access for the following purposes:
- Fulfillment: To perform our contract with you, arrange shipping, and provide order notifications.
- Customer Support: To be responsive to your inquiries, warranty claims, and to maintain our business relationship.
- Security and Fraud Prevention: To authenticate your account and assist Shopify in detecting fraudulent or malicious activity (such as bot purchasing).
- Legal Reasons: To comply with applicable Australian laws, ATO requirements, and respond to valid legal processes.
4. Relationship with Shopify & Platform Liability
Our store is built on and hosted by Shopify. Your data is stored through Shopify’s data storage, databases, and the general Shopify application. They store your data on a secure server behind a firewall.
While Gus Labs complies with the Australian Privacy Principles (APPs) regarding the data we physically handle, we do not own, manage, or control Shopify’s servers, database infrastructure, or overarching cybersecurity measures. To the maximum extent permitted by Australian law, Gus Labs expressly disclaims all liability for any loss, unauthorized disclosure, or theft of personal information resulting from a cyber-attack, data breach, or security vulnerability affecting Shopify’s platform, servers, or third-party applications. Liability for the security of the hosting infrastructure rests with Shopify Inc. For more details on how they secure your data, please review the Shopify Consumer Privacy Policy.
5. Disclosing Personal Information
We do not sell your personal information. We only disclose it to third parties for legitimate business operations, including:
- With Shopify and our selected shipping/courier partners to fulfill your PC build.
- In connection with a business transaction or to comply with applicable Australian legal obligations, enforce our policies, and protect the rights and safety of Gus Labs and our users.
6. Security and Retention
We implement commercially reasonable security measures on our local hardware to protect the customer data we do access. We retain your order history and contact information only for as long as necessary to fulfill the purposes for which it was collected, including satisfying any legal, tax (ATO), or warranty reporting requirements.
7. Your Rights and Choices
Under the Australian Privacy Act 1988, you have certain rights regarding your personal information:
- Right to Access & Correct: You may request access to the personal information that we hold about you and request that we correct inaccurate or out-of-date information.
- Communication Preferences: You may opt out of receiving promotional emails at any time by using the "unsubscribe" link provided, in accordance with the Spam Act 2003.
(Note: Gus Labs cannot delete transaction records upon request, as we are legally required by the Australian Taxation Office to retain financial transaction histories for tax auditing purposes).
8. International Transfers
By using our Services, you acknowledge and consent that your personal information will be transferred to, stored, and processed outside of Australia by Shopify, whose primary servers are located in North America.
9. Complaints
If you believe we have breached the Australian Privacy Principles and wish to make a complaint, please contact us. We will investigate your complaint and respond in writing within a reasonable timeframe. If you are not satisfied with our response, you may escalate your complaint to the Office of the Australian Information Commissioner (OAIC).
